The Form I-765 (Application for Employment Authorization) is one of the most commonly filed USCIS forms — and one of the most frequently delayed due to avoidable errors. Here are five mistakes to watch out for before you submit.
Filing Under the Wrong Eligibility Category
The I-765 has dozens of eligibility categories (e.g., (c)(9) for pending adjustment, (c)(14) for deferred action). Selecting the wrong category can result in automatic rejection. Make sure you know exactly which category applies to your immigration status.
Missing or Outdated Supporting Documents
USCIS requires specific evidence depending on your category. For example, asylum applicants must include a copy of their I-589 filing receipt. Submitting outdated documents or forgetting required attachments is a leading cause of delays.
Incorrect or Inconsistent Personal Information
Your name, date of birth, and A-Number must match exactly across all your immigration records. Even a small spelling difference can trigger a Request for Evidence (RFE) and delay your case by months.
Forgetting to Include the Filing Fee or Fee Waiver
Most applicants must pay a filing fee with their I-765. If you believe you qualify for a fee waiver (Form I-912), you must submit it with your application. Submitting without payment — or without an approved waiver — will result in rejection.
Not Signing the Form
It sounds simple, but an unsigned form is automatically rejected. If you have a preparer or interpreter assist you, they must also sign in the designated sections. Always double-check signatures before mailing.
